Trucking Insurance MCS-90

Have you ever looked closely at the MCS-90 endorsement that is attached to your trucking liability policy? If you have not there are some things that you need to understand to make sure your business is protected. The first thing is the MCS-90 endorsement is the required proof that your business is in compliance with the FMCSA insurance regulations. However, it is not a warranty by your insurance company that the limits shown on your policy meet the FMCSA requirements! You as the motor carrier, and not the insurance company, are obligated to verify that you are carrying the correct limits of insurance as required by the FMCSA.

You should also note that the MCS-90 does not require your insurance company to pay for injuries or death of any employees that may be as a result of an accident. It also does not provide any coverage for cargo.

You may be required to reimburse your insurance company in the event of a claim!! For example, your insurance company is required to pay damages for environmental restoration as a condition of the MCS-90. However, if your auto policy excludes pollution the insurance company is still going to be required to pay for the environmental restoration cost. However, in this example not only does the insurance company have a contractual right to full reimbursement, you have agreed to make such reimbursement to the insurance company for their costs via this endorsement.

It is critical that you understand how your business is covered before a loss occurs. I recommend that you contact an insurance agency that specializes in the trucking industry to make sure you are covered correctly.

Today's Trucking Regulations

Greetings to all my friends in the trucking blogosphere! This will be the start of my new blog that will address and discuss new regulations affecting today’s trucking industry. I have looked around on the internet and not yet found a forum to discuss trucking regulations and as a result I have started one that I hope will be very informative and that you will find helpful in your everyday existence in our industry.
